OFF ROAD USE POLICY

Unless otherwise noted, ALL products sold by GVS Technologies, LLC, dba Tuning Tech FS are sold with the sole intention for off road or race track use, only. This product or products may not comply with some State, Federal, Provincial and/or Local laws, ordinances, regulations or emissions.

The buyers takes full responsibility of the use of these products on their automobile which may or may not conform to all applicable laws and regulations for on road or highway use.

The buyer acknowledges that Tuning Tech FS has made him or her aware that these products are intended for off road or race track use, only.

The buyer absolves Tuning Tech FS from all responsibility in ensuring that his or her automobile is compliant with all State, Federal, Province, Local ordinances and emissions.

This waiver of compliance covers all past and future purchases from Tuning Tech FS.   

THESE PARTS ARE LEGAL FOR USE ONLY IN COMPETITION RACING VEHICLES AS DEFINED UNDER MARYLAND LAW, AND ARE NOT LEGAL FOR USE IN ANY OTHER MOTOR VEHICLE. These parts may only be used on competition racing vehicles operated exclusively on a closed course in conjunction with a sanctioned racing event. Competition-only motor vehicles may not be driven to a racing event on a public highway and must be transported on a trailer or other carrier. USE OF THESE PARTS IN ANY OTHER VEHICLE MAY SUBJECT YOU TO FINES AND PENALTIES FOR VIOLATION OF FEDERAL AND/OR STATE LAW, WILL VOID YOUR WARRANTY FROM Tuning Tech FS, AND CAN VOID YOUR VEHICLE'S WARRANTY. It is your responsibility to comply with all applicable federal and state laws relating to use of these parts, and Tuning Tech FS hereby disclaims any liability resulting from the failure to use these parts in compliance with all applicable federal and state laws.

TERMS AND CONDITIONS

1. Pricing

Prices shown on the Tuning Tech FS website are displayed in US Dollars and are subject to change, revisions and alterations without proper notice. All pricing posted are not final and does not include freight charges.  All purchases made from within the state of Maryland are subject to state sales tax.

2. Payment

Accepted forms of payment include: money orders, electronic bank transfers, Money Transfers, PayPal and most major credit cards, including, but not limited to, Discover, Mastercard, Visa, and American Express.  All duties, taxes, and other fees on international orders are the full responsibility of the purchaser.

3. Shipping

Tuning Tech FS uses USPS as its primary shipping handler.  Services through FedEx are also available.

To ensure accuracy and authenticity on credit card orders, Tuning Tech FS will only ship orders to the billing address linked to the method of payment.

If you absolutely must ship to a different address, you can call your credit card company and register an alternate address. The number should appear on the back of your credit card.

Damaged Packaging - All packages are shipped with the appropriate amount of insurance. If package appears damaged on arrival, state the damaged condition and have the driver acknowledge the damage condition as well. In the case that products appear damaged after opening, contact the carrier immediately. Save all packaging for the claim inspection.

4. Warranty Policy 

Tuning Tech FS warranties their products against defects in material and workmanship for one (1) year from the original date of purchase.  Warranty applies to original purchaser and is not transferable. 

Warranty is automatically void if:  

•  the product has been used in competition / racing
•  the product has been abused, misused, or improperly maintained
•  repairs have been made or attempted by anyone other than an authorized Tuning Tech FS repair and/or maintenance facility
•  repairs are required because of normal wear and tear
•  alterations have been attempted or made to the product
•  the product is classified as a consumable
•  the product has been involved an accident.

This warranty is limited to repairs and/or replacement of the product or part found to be defective without charge. Tuning Tech FS reserves the right to refund the complete purchase price for the defective item and will not be held liable for losses or damages arising from the defect.

Tuning Tech FS will not accept freight costs of any returned merchandise to Tuning Tech FS for inspection and/or returns. A 20% handling charge for all returns may be applied.

Under the stipulations of this warranty, Tuning Tech FS will in no way be liable for exceeding the original purchase price of the defective product. This warranty does not include the cost of removal or re-installation of the product. No person or representative is authorized to extend any warranty and/or liability (other than that which has been expressed herein) in connection with the sale of any Tuning Tech FS product.

Manufacturer’s Warranty:  Certain products carry a manufacturer’s warranty against defects.  If you believe you have a defective product it is your responsibility to check with the manufacturer for their official warranty terms and conditions. 
Customer shall notify Tuning Tech FS within 10 days of discovery of any such defects.  We reserve the right to withhold refund until the defective part has been examined and tested. Tuning Tech FS is not responsible for shipping costs on items returned under this limited warranty.  Tuning Tech FS is not responsible for labor charges due to incorrect installation or faulty or defective parts.  Products must be inspected for defect before installation.

Tuning Tech FS disclaims any and all liability for any implied warranties, including the implied warranties by other merchants regarding fitness for a specific purpose. Under no circumstances shall Tuning Tech FS be liable for any incidental, indirect, specific or consequential damages arising from purchaser's use of the product.

5. Return & Refund Policy, including Tunes:

All returned items will be thoroughly inspected prior to issuing a refund. All returns are subject to a 20% restocking fee.

 - All products must be in a new and re-sale condition.

- Returns must not have been installed, damaged, or used in any way.

- All products must be returned within 30 days of the date on the original invoice.

- NO RETURNS on any software, electrical (including ECUs), or fuel injected items.

- NO RETURNS on special order parts. Deposits on Special Orders are NON-REFUNDABLE.

- NO RETURNS on hand-held tools.

-NO REFUNDS OR RETURNS on tunes, including remote tunes, on Customer’s vehicle receiving mechanical work or modifications after the purchase and/or installation of a tune.  Tunes are built to the specifications provided on the customer tune build sheet submitted at time of purchase.  Customer agrees to purchase a re-tune or a new tune, as deemed necessary by Tuning Tech FS, if modifications are made to the vehicle. 

-NO REFUNDS OR RETURNS on tunes, including remote tunes, due to the Customer’s vehicle is experiencing any type of mechanical or electrical issue(s) at or after the time of purchase and/or installation of a tune.  Customer understands and agrees that tunes do not fix mechanical problems.  Customer agrees to purchase a re-tune or a new tune, as deemed necessary by Tuning Tech FS, after repairs are made and the vehicle is proper operating condition for tuning.

 - Buyer is responsible for all return shipping costs.

All products MUST have the RA number (Return Authorization) clearly labeled on the outside of the return package. To obtain an RA number please contact us.

Procedure for Defective Product Return:

To make a claim under this warranty, you must:

A.  Be sure the part is defective.

Make every attempt to determine that the problem is attributed to the Tuning Tech FS product. Take all steps to ensure that the problem is not caused by installation error, misapplication, modification, abuse or accident.  An inspection fee will be charged for all products sent to Tuning Tech FS for inspection and found to be in proper working order or malfunctioning due to cause other than manufacturing defect, such as incorrect installation.

B.  Obtain a RGA #

If the problem cannot be identified, obtain a RA # (Return Authorization) from Tuning Tech FS. Retain the RA# for reference.  

C.  Ship the Product Back

Clearly, mark the RA# and your last name on the outside of the package and the mailing label and send the prepaid product freight and/or postage to:

PACKAGES WITHOUT THIS INFORMATION WILL BE REFUSED AND RETURNED TO SENDER.

Tuning Tech FS is not responsible for products returned without a clearly marked RA# and return address.  Please also include a copy of your original invoice showing: 

-  A detailed description of the problem
-  A list of ALL modifications to the vehicle
-  Product part number
-  Date of purchase
-  The purchase price
-  Your name and address
-  Daytime phone number

6.  Limitation of Liability and Indemnity

Customer assumes all liability and risk arising from the ordering, purchase, use or installation of new and used parts that are purchased from Tuning Tech FS except where specifically advertise otherwise. Tuning Tech FS is in no way liable for any damages to any person or property arising out of or in connection with the use or installation of any parts that it sells or installs unless specified otherwise. Customer agrees to indemnify Tuning Tech FS from any and all claims, including legal fees,  arising out of or in connection with the use or installation of the product(s ) or service it purchased from Tuning Tech FS, including any installation.  Tuning Tech FS is not responsible for any damages or claims arising out of a delay in the processing or shipment of any order.  By purchasing products from Tuning Tech FS or by paying Tuning Tech FS to install any products, the Customer acknowledges, agrees and accepts this Limitation of Liability and these Terms and Conditions.

Tuning Tech FS’ products have no warranty or representations made with the ability to protect against injury or death.   The customer acknowledges, agrees and accepts that Improving the performance of an engine by altering the engine's computer software or hardware may increase wear on an engine and possibly result in a loss of overall engine life or premature damage, as well as the possibility of the Manufacturer's Warranty to be voided. The user assumes these risks. Tuning Tech FS is not responsible for damage to a car of this kind. Tuning Tech FS is not responsible for faulty installation, or mechanical issues of any kind during installation of remote tuning tools, including but not limited to disconnection due to poor car maintenance or battery life.

 7. Errors & Applicability

Tuning Tech FS provides this website as a representation of its products and services. These Terms and Conditions are applicable to all order placed by the customer, whether online on the Tuning Tech FS website, email or by telephone, including all future orders. Tuning Tech FS does not claim responsibility and waives all liability arising from any typographical errors, errors in pricing, or misprints.
